Asus Hasbro lawsuit related to the use of the name of Prime Transformer in products made by Asus Android tablet has been decided by the court. In this decision the United States federal judge rejected the lawsuit Hasbro and allow Asus to continue selling homemade tablet Transformer.
Hasbro filed a lawsuit late last year with claims that the use of the name of Prime Transformer will confuse buyers because of the popular robotic product to match hers. Therefore, Hasbro asked the court to apply the prohibition of the sale of the Asus tablet.
Unfortunately, the judge has another view. According to the judge, he believes that consumers will not be a loss to determine that the Asus tablet is not a Hasbro product. According to the judge, there was no similarity in the use and function between Hasbro and Asus products using the name of the Transformer.
The Court also considered the Asus has a compelling reason to use the term transformer because the product can be transformed into a tablet laptop computer dock when fitted with a QWERTY keyboard that is provided. The judge in the end also mentioned that Hasbro waited too long to make the lawsuit and could not ask for the ban even though Hasbro intends to launch Prime Transformer merchandise this month.
The court ruling, Hasbro has issued a statement strongly rejected the court's decision does not prohibit the use Asus brand transformers. Even so Hasbro also pleased with the view that the court saw the power of brands Transformer and Transformer Prime. Hasbro will continue its efforts to protect the brand that has been recognized and is known globally.
The decision also revealed interesting facts. Stated that as of the date of February 24, 2012, Asus has received over 2,000 orders .... and is expected within the next two months the company will be able to fulfill orders reached 80,000 tablet computer. If this is true, then the order number is far below that achieved during the period of ordering new iPad is able to reach 3 million units.
